These Terms of Service (this “Agreement” or “Terms”) are a legally binding agreement between you and Spot Reservations governing your use of https://spotreservations.com and any related services we provide (collectively, the “Service”).

Important disclosure: Spot Reservations is an independent travel connection directory. We are not the travel company and we are not travel agents. We connect you to independent, third‑party travel reservation specialists, and we may receive affiliate compensation for qualified connections.

1. Acceptance of These Terms

By accessing or using the Service in any manner, including by visiting or browsing the Site, clicking on content, initiating a telephone call to any number displayed on the Service, or otherwise interacting with the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, you must not access or use the Service. You represent that you are at least eighteen (18) years of age (or the age of majority where you live) and have legal capacity to enter into this Agreement. If you use the Service on behalf of an entity, you represent that you have authority to bind that entity.

2. Description of the Service; No Travel Sales; No Agency Relationship

The Service is an independent directory and connection service that may help you reach third‑party travel reservation specialists and/or other third‑party providers (collectively, “Third‑Party Providers”). Spot Reservations does not sell or issue tickets, does not process payments for travel purchases, does not act as a travel agent, and does not control Third‑Party Providers’ inventory, pricing, availability, fees, schedules, policies, or performance.

Nothing in the Service or these Terms creates any agency, partnership, joint venture, employment, or fiduciary relationship between you and Spot Reservations, or between Spot Reservations and any Third‑Party Provider. Any booking, purchase, modification, cancellation, refund request, dispute, or other transaction you pursue occurs solely between you and the applicable Third‑Party Provider.

3. Third‑Party Providers; Third‑Party Terms

The Service may display phone numbers, links, or other ways to connect you to Third‑Party Providers. Third‑Party Providers are independent entities not owned or controlled by Spot Reservations. We do not endorse, verify, guarantee, or warrant any Third‑Party Provider or any travel product or service they may offer.

Your dealings with any Third‑Party Provider are subject to that Third‑Party Provider’s own terms, conditions, and privacy policies. You are solely responsible for reviewing and understanding those terms before providing personal or payment information or completing any transaction.

4. Phone Calls, Call Routing, and Call Recording

The Service may use third‑party call routing, tracking, and measurement technology (including, without limitation, MarketCall or similar providers) to connect telephone calls and measure performance. When you call a number displayed on the Service, information such as your phone number, call date/time, call duration, routing details, and call outcome data may be collected and processed by call technology partners and/or the Third‑Party Provider you reach.

Calls may be monitored, recorded, and/or transcribed by call technology partners and/or Third‑Party Providers for quality assurance, training, compliance, analytics, and fraud prevention purposes, subject to applicable law and third‑party policies. If you do not wish for a call to be recorded, do not place the call, or ask at the start of the call whether recording is active and what options are available. Consent requirements vary by state.

5. Acceptable Use

You agree not to misuse the Service. Without limitation, you agree not to (a) attempt to gain unauthorized access to the Service or related systems; (b) interfere with or disrupt the integrity or performance of the Service; (c) use automated means (including bots, scrapers, or spiders) to access the Service without our prior written consent; (d) use the Service for unlawful, fraudulent, deceptive, or abusive purposes; or (e) attempt to reverse engineer or circumvent any security or access controls.

6. Intellectual Property

The Service, including its content, design, layout, text, graphics, logos, and functionality, is owned by Spot Reservations or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, display, publish, license, create derivative works from, or sell any portion of the Service without our prior written consent.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPOT RESERVATIONS DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, SPOT RESERVATIONS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE, OR THAT ANY CONNECTION TO A THIRD‑PARTY PROVIDER WILL RESULT IN A SUCCESSFUL BOOKING OR ANY PARTICULAR OUTCOME.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SPOT RESERVATIONS (OR ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, OR AFFILIATES) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR YOUR INTERACTIONS WITH ANY THIRD‑PARTY PROVIDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPOT RESERVATIONS’ TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT PAID BY YOU TO SPOT RESERVATIONS FOR USE OF THE SERVICE IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER. FOR CLARITY: IN MOST CASES YOU DO NOT PAY SPOT RESERVATIONS ANY FEE FOR USE OF THE SERVICE.

Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Spot Reservations and its owners, officers, directors, employees, contractors, agents, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; or (d) your interactions, transactions, or disputes with any Third‑Party Provider.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms or used the Service in a manner that may create legal risk or harm. Upon termination, your right to use the Service will immediately cease.

Provisions that by their nature should survive termination shall survive, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.

11. Governing Law; Venue

These Terms (and any dispute or claim arising out of or relating to these Terms or the Service) shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Subject to applicable law, you agree that any legal action arising out of or relating to these Terms or the Service shall be brought in the state or federal courts located in California, and you consent to personal jurisdiction and venue in such courts.

12. Changes to These Terms

We may modify these Terms at any time by posting the updated Terms on the Site and updating the “Last Updated” date. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
